Welcome to Hosmain. These Terms of Service ("Terms") govern your access to and use of Hosmain's hosting services, websites, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under applicable law
  • Provide accurate and complete registration information

By using our Services, you represent and warrant that you meet these requirements.

3. Account Registration

Hosmain provides cloud hosting, VPS, dedicated servers, and related services as described on our website. Specific features and resources depend on your selected plan.

4.2 Acceptable Use

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Distribute malware, spam, or harmful content
  • Conduct unauthorized access attempts or hacking
  • Send unsolicited communications without consent
  • Host illegal or prohibited content
  • Overload or disrupt our infrastructure

4.3 Resource Usage

Each plan has defined resource limits (storage, bandwidth, CPU, etc.). Excessive usage that impacts other users may result in throttling or account review.

5. Payment and Billing

5.1 Pricing

All prices are as stated on our website and are subject to change with notice. Prices do not include applicable taxes unless otherwise stated.

5.2 Payment Terms

  • Payments are due in advance on the billing date
  • We accept major credit cards and other payment methods shown at checkout
  • Failed payments may result in service suspension
  • You are responsible for all charges under your account

5.3 Refunds

We offer a 30-day money-back guarantee on all hosting plans. After 30 days, refunds are prorated based on remaining time. Domain registrations and add-on services are non-refundable.

5.4 Renewal

Services automatically renew at the end of each billing cycle unless cancelled. You will receive notice before renewal charges.

6. Service Level Agreement (SLA)

We guarantee 99.9% network uptime for all hosting plans. If we fail to meet this guarantee:

  • You may be eligible for service credits
  • Credits must be requested within 30 days of the incident
  • Credits apply to future service charges only
  • Scheduled maintenance and force majeure events are excluded

7. Data and Backups

While we implement backup systems, you are ultimately responsible for your data. We strongly recommend maintaining your own backups. We are not liable for data loss resulting from hardware failure, user error, or other causes.

You retain all rights to your data. We do not claim ownership of content you host on our servers.

8. Intellectual Property

Hosmain and its licensors own all rights to the Services, including software, designs, text, images, and trademarks. These Terms do not grant you any intellectual property rights except the limited right to use our Services as intended.

9. Termination

Either party may terminate these Terms:

  • By You: Cancel your account at any time through your dashboard
  • By Us: For violations of these Terms, non-payment, or other legitimate reasons

Upon termination, your right to use the Services ceases immediately. We may retain backup copies of your data for a limited period as required by law.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSMAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Hosmain and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of any third party
  • Content you host or transmit through our Services

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco, California.

14. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved within 60 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
  • Entire Agreement: These Terms constitute the entire agreement between you and Hosmain
  • Force Majeure: We are not liable for delays due to causes beyond our reasonable control
